1. Agreement

By using broskeyenergy.com you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the site. The site is operated by Broskey Energy, Jaipur, Rajasthan 302003, India.

2. The site

This is a brand website: information about Broskey, a store locator, a waitlist for the shop, a public photo wall, and a contact form. It is free to use. Nothing here is an offer to sell; when the shop opens, sales will carry their own terms.

3. Eligibility

You must be 18 or older to use this site, join the waitlist, or post to the wall. Energy drinks are not recommended for children, pregnant or breastfeeding people, or anyone sensitive to caffeine.

4. No accounts

There is no sign-up. Everything you submit is submitted per visit, and you are responsible for what you send us and post from your device. Anything held only in your browser can be lost when you clear your browser data — that’s on the browser, not on us.

5. Acceptable use

Don’t post

• Anything unlawful in India or in your own country.
• Sexual content, content involving minors, hate speech, threats, harassment, or graphic violence.
• Photos, artwork, logos or music you don’t own the rights to, or images of other people who haven’t agreed to appear.
• Anyone’s private information — phone numbers, addresses, ID documents, yours or otherwise.
• Spam, promotions, links to malware, or content impersonating Broskey or anyone else.

Don’t do

• Scrape, crawl or automate the site beyond ordinary browsing.
• Bypass rate limits, moderation, or any security measure.
• Probe, load-test, or attempt to break our API or infrastructure.
• Reverse engineer or copy the site to pass it off as your own.

We may remove content, block an IP or device, and take legal action where a violation warrants it.

6. Your content, and the wall

You keep ownership of the photos and captions you post. By posting, you grant Broskey a non-exclusive, worldwide, royalty-free licence to host, resize, display and share that content on this site and on Broskey’s social channels, with credit where we have it. You confirm you have the right to grant this.

The wall is moderated after the fact, not before. Anyone can report a post; posts that collect enough reports come down automatically, and we can remove anything at our discretion without notice. Want your own post removed? Email us and we will take it down.

Content on the wall is posted by users, not by us. We don’t endorse it and we aren’t responsible for it. Copyright complaints go to support@broskeyenergy.com with the post link and proof of your rights; we act on valid notices promptly.

7. Product information

Ingredients, nutrition, pricing and availability shown here are believed accurate at the time of posting and may change. The label on the can is the authoritative source. Broskey is a beverage, not a medicine: nothing on this site is a health claim or medical advice, and nothing here promises a result. Consume responsibly and consult a doctor if you have a medical condition.

8. Store locator and waitlist

Store listings are best-effort — stock moves, shops close, so call ahead. Joining the waitlist reserves nothing and guarantees no price or stock. You can unsubscribe at any time.

9. Third-party services

The site relies on Cloudflare, Cloudinary and Resend, and links out to Instagram and other sites. Their terms and policies apply to their part of the ride, and we aren’t responsible for external sites we link to.

10. Free, and no uptime promise

The site is provided free, on a best-effort basis. We may change, rate-limit, pause or remove any feature — including the wall — at any time, without notice. We don’t promise uninterrupted service and we’re not liable for downtime.

11. Our intellectual property

The Broskey name, the बरोस्की wordmark, the logos, can design, packaging, photography, copy, illustrations, site design and code are ours (or licensed to us). You may not copy, modify or redistribute them without written permission. Your own posted content is excluded from this section.

12. Disclaimer of warranties

The site is provided “as is” and “as available”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted, error-free or secure, or that store listings, product information or user content will be accurate or complete.

13. Limitation of liability

To the maximum extent permitted by law, Broskey Energy is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of this site, and our total liability for any claim relating to the site is capped at ₹5,000. Nothing here limits liability that cannot be limited by law — including under the Consumer Protection Act, 2019 in India — and some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.

14. Indemnity

You agree to indemnify Broskey Energy against claims, damages and reasonable legal costs arising from content you post, your use of the site, your breach of these Terms, or your infringement of someone else’s rights.

15. Governing law

These Terms are governed by the laws of India. The courts at Jaipur, Rajasthan have exclusive jurisdiction, except where the law of your country of residence gives you the right to bring a claim locally.

16. Changes

We may update these Terms. Material changes will be posted here with a new “last updated” date, and your continued use of the site after that constitutes acceptance of the revised Terms.
